What is Mediation?

Mediation is a process where a neutral third party, who is called a mediator, acts to encourage and facilitate a resolution of a dispute between two or more parties. It is an informal and non-adversarial process with an objective of helping parties reach an acceptable and voluntary agreement.

In a mediation, decision making authority rests with the parties. The role of the mediator, includes but is not limited to identifying the particular issues of the dispute and fostering problem solving, which ideally leads to resolution.

At the end of a session or the mediation processes, parties can have a complete agreement, a partial agreement, or no agreement, or the parties can agree to reconvene when they have additional information that is needed, or they need more time.

When Can I Hire a Mediator?

A mediator can be hired prior to an action being filed. If the parties are not represented by their individual attorney, then that type of mediation is called a pro se represented pre-suit mediation. If a full agreement is reached at the end of mediation, then the parties can proceed in an uncontested fashion, without the expense and time of a litigated case.

Additionally, a mediator can also be hired by litigants, who are represented by their individual attorney or who are pro se (self-represented), during a pending case, in hope for a resolution prior to trial.

Will a Judge Know the Details of Mediation if the Case Does Not Settle?

No, all communications made during mediation are confidential, except where disclosure is required or permitted by law. This shall include all offers of settlement.

Mediation Rates and Pricing

Mediation Rates: Parties with a combined annual gross income of less then $100,000, the cost is $150.00 per person, per session. A session is 3 hours or less. If mediation exceeds 3 hours, the cost will be $65.00 per person, per hour.

Parties with a combined annual gross income of more than $100,000, my hourly rate is $250 per hour. Mediations scheduled less for 3 hours or less, no hourly minimum is required. Mediations scheduled for more than 3 hours, a 2 hour minimum is required.

Schedule: Please contact the office at 321-914-4710 to receive an appointment that works best for you. Mediations are scheduled seven days a week to allow for flexibility for working individuals. Mediations are scheduled between the hours of 9:00am and 8:00pm.

Mediation Timeline

As with any legal process, Mediation can be short or it can be long. Mediation is usually much shorter than other legal processes however. Sometimes parties can have a resolution after one meeting and all can be wrapped up within a few weeks.

Mediation is by far the best route to go for any legal dispute and should be tried before proceeding down any other legal route.
