Social Media and Divorce

social media and divorce

Category: Divorce , Family Law

By now everyone is aware of the effect social media has on every day life. Personal relationships and marriages are no exception. A study done recently showed the following statistics:

  • 1/7 divorces are set in motion by something done on social media.
  • 20% of divorce cases involve Facebook in some way.
  • 1/3 divorces start as a result of affairs begun online.
  • 30% of Tinder members are married.
  • Posts on social media have been used in court.

That last one seems to be of greatest concern to many people. We all feel we should be able to post something to our friends and not have to worry about it being used against us later. But that is not the reality of life. If you walked into a room full of your friends and shouted something inflammatory, it would affect your personal life. Plain and simple. Facebook is no different than that scenario.

Social media posts are used in court to prove:

  • A person’s state of mind
  • Communication (i.e. text messages, emails, dating apps)
  • Time and place of specific events
  • A person’s actions (i.e. proof of infidelity)

Things have gotten so bad with social media and divorce that some couples are signing prenuptial agreements which contain specific terms specifically regarding it.

Warning people to be careful what they post online seems passe’ these days but stressing that posting anything about your troubled marriage can very damaging is something we cannot do enough. When it comes to your marriage and posting troubles about it on social media we urge you to just DON’T DO IT.
