Social Security Fairness Act Signed into Law

Social Security Fairness Act Signed into Law

Category: Disability Law

The Social Security Fairness Act is now law, a move celebrated as a victory for public employees nationwide. The Government Pension Offset (GPO) and the Windfall Elimination Provision (WEP), two laws that have long penalized public employees who have also received Social Security benefits from other jobs, are repealed by this historic legislation.

The GPO and WEP have affected public servants such as police, firefighters and teachers disproportionately. They did so by reducing (or even eliminating) Social Security benefits for public sector workers who did not have Social Security taxes taken from their paycheck.

To guarantee that public employees receive the full amount of Social Security benefits they are entitled to, the Social Security Fairness Act eliminates these antiquated and unjust provisions. Numerous people and families who have been unjustly punished for their service will now have much-needed financial security thanks to this change.

The SSA is currently working hard to enact all the changes which come along with the new law. It is not a very fast moving process but they are moving as fast as they can. It is unclear if the law provides any backpay for the individuals mentioned above. That remains to be seen.

In order to guarantee that all Americans, including those who have devoted their professional lives to public service, can obtain the full amount of Social Security benefits they are entitled to, the Social Security Fairness Act is an important step. Numerous people and families will benefit financially from this law, which is evidence of the strength of advocacy and the fight for justice.
